Infomate terms & conditions

Welcome to Infomate, a platform owned and operated by SOUTH AND NORTH LIMITED. These Terms and Conditions govern your access to and use of the platform. By accessing or using any part of the platform, you agree to these Terms and Conditions. If you do not agree, please discontinue use of the platform.

1. Acceptance of Terms

By using Infomate, you agree to be bound by these Terms and Conditions, as well as any applicable laws and regulations in New Zealand. You confirm that you are 18 years of age or older, or that you have the consent of a parent or guardian if you are under 18.

2. Registration and Account Security

• Account Creation: To access certain features, such as posting in the Marketplace or submitting content to the IM section, you must create an account. During registration, you agree to provide accurate, current, and complete information.
• Account Responsibility: You are responsible for maintaining the confidentiality of your account details, including your password. You agree to notify Infomate immediately if you suspect any unauthorized use of your account.
• Account Termination: Infomate reserves the right to suspend or terminate your account at any time if you breach these Terms and Conditions or engage in any unlawful activity.

3. Permitted Use of the Platform

• You may only use the platform for lawful purposes. You agree not to:
• Post or transmit any content that is harmful, defamatory, obscene, illegal, or infringes on the rights of others.
• Use the platform to distribute spam, phishing scams, or malicious software.
• Attempt to interfere with the platform’s security or disrupt its functionality.

4. Marketplace Use

• Listings: The Marketplace allows users to post advertisements for goods and services, including second-hand items, real estate, cars, and boats. You agree to ensure that all listings are accurate, lawful, and comply with New Zealand laws, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
• Transactions: Infomate is not a party to any transactions conducted between buyers and sellers. You acknowledge that any agreements or disputes that arise from Marketplace interactions are solely between the buyer and seller.
• Fees and Payments: Infomate may charge fees for premium listings or additional features. All fees will be clearly communicated before posting, and payments are non-refundable unless otherwise required by law.

5. Content Submission and Ownership

• User Content: By submitting content, including but not limited to videos, photos, and articles, to the IM section, you grant Infomate a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute the content for the platform’s purposes.
• Content Responsibility: You affirm that you own the content or have the necessary rights to submit it. You also affirm that the content does not violate intellectual property laws, including the Copyright Act 1994, or any other applicable laws in New Zealand.
• Content Moderation: Infomate reserves the right to remove or edit any content submitted to the platform if it is deemed inappropriate, offensive, or unlawful.

6. Intellectual Property

• Ownership: All intellectual property on the platform, including text, graphics, logos, and software, is owned by SOUTH AND NORTH LIMITED or licensed to it. You may not copy, reproduce, or create derivative works from any content on the platform without express written permission.
• Trademarks: Any trademarks, logos, or service marks displayed on the platform are the property of SOUTH AND NORTH LIMITED or their respective owners. Unauthorized use is strictly prohibited.

7. Privacy and Data Protection

Your use of the platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the platform, you consent to the practices described in the Privacy Policy. For details, please refer to Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by law, Infomate and SOUTH AND NORTH LIMITED disclaim all liability for any indirect, incidental, or consequential damages arising from your use of the platform. This includes, but is not limited to:

• Loss of profit, data, or business opportunities.
• Any errors, interruptions, or inaccuracies in the platform’s content.
• Damages caused by transactions or interactions between users.

9. Indemnification

You agree to indemnify and hold harmless SOUTH AND NORTH LIMITED, its directors, employees, and affiliates from any claims, damages, or expenses arising from:

• Your use of the platform.
• Any content you submit.
• Any breach of these Terms and Conditions.

10. Termination of Access

• Termination by Infomate: Infomate reserves the right to terminate or suspend your access to the platform without prior notice if you breach these Terms and Conditions or engage in unlawful activities.
• User Termination: You may close your account at any time by contacting Infomate customer support. Upon termination, your right to access the platform will cease immediately.

11. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of New Zealand, and any disputes arising out of or in connection with these terms shall be resolved in the courts of New Zealand.

12. Amendments to Terms

Infomate may amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting to the platform. It is your responsibility to review these terms periodically. Your continued use of the platform after any changes are posted constitutes acceptance of the modified terms.
